ChatGPT, EU and privacy: big trouble coming for OpenAI?

OpenAI is back in the spotlight due to a complaint, filed by noyb no-profit compared to the inability to ChatGPT to protect users against disinformation.

The tendency of AI to fall into hallucinations is now proven. Despite this, some of these errors run counter to the General Data Protection Regulation (GDPR) in force in Europe.

This move, therefore, puts the company Sam Altman in an awkward position. For violations of the GDPR, in fact, fines can reach up to 4% of turnover overall of a company. On the other hand, situations were experienced in our country during 2023: at that time, in fact, ChatGPT was temporarily blocked on Europen territory.

According to what emerged on the site TechCrunchthe procedure requested against OpenAI would have started from Austria and would concern an incorrect date of birth proposed by the well-known chatbot.

For the GDPR, people residing in the EU can take advantage of the right to have incorrect data corrected. For noyb, at least at the moment, this path is not viable with ChatGPT, since it is technically impossible for a user in this regard.

ChatGPT in contrast with the GDPR: here is the second reason why OpenAI is taking a risk

According to OpenAI’s privacy policy, if you have inaccurate information about an individual, they can submit a correction request through the appropriate site (or by sending an email to [email protected]). Despite this, the company underlines that, given the complexity of the AI ​​model in question, an actual correction may not be possible.

Even if it exists un form to request the removal of all personal data from the ChatGPT output, everything remains very complex and not accessible to all users.

noyb’s complaint, however, does not stop there. The company, in fact, claims that OpenAI is unable to show where the data it generates on people comes from. This is another problem for the company, since in theory users should be able to have it access to the source of data concerning your person.

While waiting for the EU’s next move, a rather difficult period promises to be ahead for OpenAI, not only as regards European territory.
